Terms & Conditions

Last updated: [date]

Who you are contracting with

Sillage ("the Service") is operated by [Your Legal Business Name] ("we", "us"). These Terms & Conditions form an agreement between you and [Your Legal Business Name]. Trading name, if different: [trading name]. Registered address: [registered address]. Contact: [contact email address].

By creating an account or continuing to use the Service you accept these Terms. If you do not agree, please stop using the Service.

If you are using the Service on behalf of a business, you confirm you have authority to bind that business. If you are signing up as an individual, you confirm you are of legal age to form a contract in your jurisdiction.

What the Service does

Sillage lets you build a record of the perfumes you own (by photographing a bottle or typing its name), receive a daily scent recommendation, log how fragrances wear throughout the day in a journal, see insights about your collection, and receive suggestions for new fragrances. Some features are free; the Premium subscription unlocks additional limits and features.

Your account

You are responsible for keeping your sign-in credentials confidential and for all activity that happens under your account. You agree to provide accurate information and to keep it up to date.

Acceptable use

You must not misuse the Service. In particular, you must not:

  • use it for any unlawful purpose, or in a way that infringes anyone's rights;
  • commit or encourage fraud, spam, or other abusive behaviour;
  • infringe intellectual property rights, including uploading content you have no right to use;
  • interfere with the Service's security, including introducing malware, probing or scanning vulnerabilities, scraping, or circumventing usage limits and technical restrictions;
  • resell, redistribute, or provide access to the Service to third parties;
  • reverse engineer the Service except where permitted by law.

AI features

Parts of the Service use artificial intelligence, including perfume recognition from photos, daily recommendations, and generated suggestions.

  • You are responsible for the photos and text you submit and for how you use the outputs.
  • AI output may be inaccurate or incomplete. Always verify a perfume identification, its notes, and any purchase suggestion before relying on it. Nothing in the Service is professional advice (for example dermatological or medical advice about fragrance ingredients).
  • You must not use the AI features to create illegal content, non-consensual imagery, hate speech, malware, or to attempt to bypass the Service's safety measures.
  • You keep the rights in the content you submit and confirm you have the rights to submit it. Rights in generated output are allocated as described here and by applicable law; we claim no ownership of your photos or journal entries.
  • If you believe content in the Service infringes your rights, contact us at [contact email address]. We will investigate and, where appropriate, remove the content. Repeated infringement may lead to suspension of your account.
  • We may remove or restrict content, refuse or filter AI outputs, and suspend accounts that violate these Terms.

Subscription, payment and refunds

Premium is offered on a monthly or yearly subscription that renews until cancelled. Cancelling keeps your access until the end of the period you have already paid for. Switching plans takes effect immediately and charges or credits the difference.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payments, billing, taxes, cancellation and refund mechanics are handled by Paddle and governed by Paddle's Buyer Terms: paddle.com/legal/checkout-buyer-terms. Our refund policy is described on our Refund Policy page.

Your content

You keep ownership of the photos, notes and journal entries you create in the Service. You grant us a limited licence to host and process that content solely to provide the Service to you (for example, recognising a perfume from a photo or calculating your insights).

Our intellectual property

We (and our licensors) own the Service itself — its software, design, branding and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. Nothing in these Terms transfers ownership of the Service to you.

Availability

We do not guarantee that the Service will be uninterrupted, timely or error-free, or that specific features (such as perfume identification from a photo) will always succeed. We may change, suspend or discontinue parts of the Service, and will try to give reasonable notice for significant changes.

Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if: you materially breach these Terms; payment fails; keeping your account active would create a security or fraud risk; or you repeatedly or seriously violate our policies.

When your account ends, your photos, journal entries and collection data are deleted in line with our Privacy Notice. You can download your saved data and photos from the Account page before deletion. Permanent account deletion also stops Premium renewals immediately and ends access; it does not automatically issue a refund.

Disclaimers and liability

To the fullest extent permitted by law, the Service is provided "as is" and all implied warranties (including merchantability and fitness for a particular purpose) are excluded.

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our total aggregate liability to you is capped at the fees you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud, death or personal injury caused by negligence.

You agree to indemnify us for claims arising from content you submit, your unlawful use of the Service, or your breach of these Terms.
